3. Counter-Notification Process
If material that you posted to the Website has been removed or disabled due to a DMCA notice, you may file a Counter-Notification. To be effective, the Counter-Notification must be a written communication sent to our Designated Agent that includes substantially the following:
- Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or disabled.
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
- Your name, address, and telephone number.
- A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if you are outside the United States, that you consent to the jurisdiction of any judicial district in which the Website service provider may be found), and that you will accept service of process from the person who provided the original infringement notification.
- Your physical or electronic signature.
4. Repeat Infringer Policy
In accordance with the DMCA and other applicable law, diucryptics.com has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, users, contributors, or account holders who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to the Website and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
